Nepali associations in the United States of America on promulgation of Nepal’s new constitution and India’s undeclared embargo

Nepal has entered a new era with the promulgation of a new constitution on September 20, 2015. The constitution was overwhelmingly passed by the members of the Constituent Assembly (CA), a body directly elected by the people as well as by proportional representations from all ethnic and political groups.

The Indian government and their media allies have distorted the truth by telling the world that only fifty percent of Nepalis have supported the constitution despite the fact that the constitution was promulgated with an overwhelming majority of ninety percent of the CA members.

The new constitution may not have satisfied every group at every level in Nepal; the constitution is a dynamic living document and it can be amended peacefully by a democratic process as needed. The US constitution was amended 27 times and the Indian constitutions 94 times, both constitutions were promulgated by the majority of two-third of their CA members. The constitution adopted by Nepal’s Assembly is a sacred document for all the sovereign citizens of Nepal. It should be honored without any reservations by all democratic and sovereign nations. 

Passing of a new Constitution should have been a historical moment for Nepal, yet it was shadowed by the last minute attempt by India to stop the constitution process, which was further dampened by the 7-point demand to amend newly passed constitution and by a trade embargo imposed by India. This action is against the World Trade Organization (WTO) and the rights of a Land Locked Country (LLC).

While, the Indian Government has denied making any demand to amend the constitution and has categorically disowned the trade embargo, its actions at the border suggest otherwise. 

India’s attempt to impose its will to delay the promulgation of the Nepali Constitution, as well as, trying to punish Nepal with the trade embargo for not following its orders has not only crossed all lines of decency and norms between two nations, it has also violated the UN charter on trade.

Therefore, on behalf of all Nepalis and friends of Nepal, we, the representatives of the following Nepali Organizations in the United States would like to appeal to the Indian Prime Minister Shri Narendra Modi to recognize and honor the constitution of Nepal, a Sovereign Nation, by not interfering in its internal matters, and by allowing free flow of goods from India and other trading partners to Nepal.  

We would also like to appeal to the Government of Nepal, as well as, to agitating political parties to resolve all disputes and disagreements quickly and peacefully.

नेपाल संविधानको हार्दिक स्वागत गरौ ! सबैलाई शुभ कामना !!                                                                                                    

हाम्रो प्यारो मातृभूमि नेपालमा संविधान जारी भएको छ । यसबाट लामो समय देखि नेपाली जनताका निर्वाचितप्रतिनिधिहरुले संविधान बनाउन चाहेको सपना पुरा भएको छ ।यस अवसरमा हामी विशेष गरि अमेरिकाको दक्षिण–पूर्वी राज्यहरूमा बस्ने नेपालीहरू संविधानको हार्दिक स्वागत गर्दछौ र  विभिन्न तह र तप्कामा स्वदेश तथा बिदेशमारहेका सबै नेपाली दाजुभाई तथा दिदीबहिनीहरुलाई हार्दिक बधाई तथा शुभकामना ब्यक्त गर्दछौं ।

लोकतन्त्र ,मानव अधिकार र संघीय गणतन्त्र नेपालको प्रत्याभूति गर्ने यो संविधानले शान्ति प्रक्रियालाई तार्किक निस्कर्षमा पुर्याएर राजनीतिक अध्यायबाट मुलुकलाई आर्थिक तथा सामाजिक समृदिको नयाँ अध्यायमा प्रवेश गर्ने मार्ग प्रशस्तगरेको छ ।

संविधानले विदेशमा रहेका हामी सम्पूर्ण नेपालीलाई आफ्नो मातृभूमि र मूलुसंग जोड्न आर्थिक ,साँस्कृतिक रसामाजिक अधिकार सहितको गैर आवासीय नेपाली नागरिकताको व्यवस्था गरेको छ ।”एकपटकको नेपाली ,सधैंकोनेपाली“हुने न्युनतम शर्तका रुपमा आएको यो प्रावधानको हामी मनै देखि स्वागत गर्दछौ ।

यो संवैधानिक व्यवस्था संगै मुलुकले प्रवासमा रहेका नेपालीहरुलाई केहि नै दिएन भनेर गुनासो गर्ने एउटाकालखण्डको अन्त्य भएको छ र समुन्नत नेपाल निर्माणका  लागि सबैले यथेस्ट योगदान गर्ने समय आएको छ।यसदिशामा विश्वभरिको नेपाली डायस्पोरामा छरिएर रहेका सबै नेपाली एक जुट भएर सक्रियतापूर्वक लागिपर्ने समयआएको छ । नेप्लिज एशोसियसन अफ साउथ इष्ट अमेरिका ( नासा ) यसमा कृतसंकल्पित भएर लागिपर्नेछ र सबैलाईत्यसका लागि हार्दिक आग्रह पनि गर्दछ ।

एक जुगमा एक पटक बनिने भए पनि संविधान कहिल्यै पूर्ण हुदैन । पूर्णताका लागि यसले समय ,परिस्थिति रजनचाहनाको कसीमा परिक्षण हुदै जानु पर्छ । नेपालको संविधान पनि यसबाट अछुतो छ भनेर भन्न सकिन्न। त्यसैलेयसमा केहि अपुग हरु छन् भने तिनीहरुलाई  संशोधन मार्फत पुरा गर्दै सबै नेपालीले स्वामित्व ग्रहण गर्ने खालकोसंविधान निर्माणमा लागि रहनु पर्दछ । संविधान जारी भएको यो बेलामा नेपालका विभिन्न भाग र समुदाय बाट उठेकाआवाज पनि सुनिनु पर्छ । यसो गर्न सकियो भने मात्र संवाद ,सहमति र सहकार्य को असल संस्कृति निर्माण हुन् सक्छ ।समृद् नेपाल निर्माण का लागि पनि हाम्रो मुलमन्त्र यहि हुनसक्छ ।

संविधानको पवित्र भवन लागू/अनुशरण गर्दै हाम्रो मातृभूमिलाई समृद् बनाउन हामी सबैलाई शक्ति र सामर्थ्य प्राप्तहोस्।

The election of the Board of Officers and Directors of the Nepalese Association in Southeast America (NASeA) was conducted during the NASeA-ANMA Joint Convention in Embassy Suites, Greensboro, NC on Sunday September 6, 2015. The results are shown below and also attached in the PDF file.

The Election Committee likes to thank the following

(a) All voters and candidates;

(b) Verification Committee  – Prakash Malla, Chair; Ajaya Satyal, Member; and Lekh Nath Ghimire, Member. and IT specialists Ritesh Adhikari, Samir Upadhyay, and Shailendra Bajracharya.

(c) Volunteers including Dr. Hari Dhungana, Saubhagya Shrestha, Raju Thapa, Dr. Lila Karki, Gopendra Bhattarai, C.K. Parajuli, Dr. Batu Sharma, Madhav Mainali, Dr. Uma Karki, Nirmala Rajbhandari, Ambika Tiwari, Raj Ghimire, and Shiva Rai who helped the Committee in checking IDs and/or counting of votes.

Dr. Keshab Paudel was born and raised in Nepal. He graduated from Tribhuvan University, Kathmandu Nepal in 2002. After his graduation from medical school, he worked for 3 years there prior coming to the US for his post-graduate training. He completed his Internal Medicine internship and residency from Montefiore Medical Center, Bronx New York. Then, he joined United Health Services Hospitals/ SUNY Upstate Binghamton in July 2010 as hospitalist physician. He was a teaching faculty for the residents and medical students there. He enjoyed the position of Core faculty of the residency program and Assistant professor of clinical medicine. While working as an academic hospitalist and member of the residency committee, he decided to pursue his MBA from University of Tennessee and completed in December 2013. In November 2013, Dr. Paudel assumed new role as a director of a hospital medicine program with Lovelace Health System/Hospital Physician Partners. He was promoted to an Associated System Medical Director in June 2014. In March of 2015, Dr. Paudel joined Concentra as an Area Medical Director.

He was heavily involved in social work since the early days in his life. He was the president of Junior Red Cross Committee while in the high school. He led free student union in various capacities while in Tribhuvan University. He was the president of Technical student forum in Nepal during the year 1998-2000. He was elected to the post of Central member of Nepal student union in 1999-2001. He had served on the board of America Nepal Medical foundation. He is currently an advisor of Blood donors of America. He serves as the President of Society of Hospital Medicine, New Mexico Chapter and Membership director of American College of Physician, New Mexico. He is currently the Fellow of American College of Physician and senior fellow of Hospital medicine.

Dr. Paudel was one of the advisors of the NRN NCC of USA in the year 2014-2015. Now, he is the elected President of NRN NCC USA 2015-2017.

He has done extensive research in the area of quality initiatives and process improvement. He chaired various hospital committees including but not limited to Pharmacy and therapeutics, Peer review, and Quality committee. He was awarded with best Medical Officer Award while at Tribhuvan University. He is married with 7 year old son. He is engaged in many voluntary social works, likes hiking and enjoys listening to music. He enjoys playing table tennis in his spare time.
